In 2012 automaker Mazda recalled approximately 217,500 Tribute sport-utility vehicles due to defective accelerators. The defect can cause the gas pedal to become stuck, dangerously accelerating the vehicles.
According to the L.A. Times, a National Highway Traffic Safety Administration investigation found a total of 68 complaints about the issue, which also affects over 400,000 Ford Escape SUVs. The NHTSA report noted at least 13 accidents stemming from the defect, resulting in at least nine injuries and one death.

“Defendant Mazda North American Operations (MNAO) marketed and sold a Mazda Tribute with a defective accelerator and speed control system that caused Mazda Tributes to accelerate out of control. MNAO knew about this defect and concealed it from the public and the Federal agency which regulates car design, NHTSA, for years. The defect caused the accelerator control cable of this Mazda to get stuck in the 75% depressed state. The Mazda rocketed into and crushed another car. [Plaintiff] was a passenger in that other car. The Mazda crushed the skull of [Plaintiff], and caused amongst other things loss of [Plaintiff’s] right eye and traumatic brain injury.”
