What is distracted driving?
According to the NHTSA:
Distracted driving is any activity that diverts attention from driving, including talking or texting on your phone, eating and drinking, talking to people in your vehicle, fiddling with the stereo, entertainment, or navigation system — anything that takes your attention away from the task of safe driving.
Texting is the most alarming distraction. Sending or reading a text takes your eyes off the road for 5 seconds. At 55 mph, that's like driving the length of an entire football field with your eyes closed.
There are three main types of distractions:
- Visual – taking your eyes off the road
- Manual – taking your hands off the wheel
- Cognitive – taking your mind off driving
Common examples of distracted driving include texting or using a phone, eating or drinking, adjusting the radio or GPS, talking to passengers, or daydreaming.
Texting while driving is especially dangerous because it involves all three types of distractions. The NHTSA reports that 3,308 people were killed in 2022 by distracted drivers. Many of these car accidents happened right here in Miami.
What types of injuries does distracted driving cause?
Distracted driving crashes often happen suddenly, and that surprise impact can cause serious injuries, like the following:
- Whiplash and neck injuries
- Concussions and traumatic brain injuries (TBI)
- Broken bones
- Back and spinal cord injuries
- Internal bleeding
- Cuts and bruises
- PTSD and emotional trauma
Some of these types of injuries can last a lifetime. Others may require surgeries, therapy, or long-term care. You should not have to pay for any of it if the crash was not your fault.
“NOT FOR EVERYONE. FOR YOU, THE SERIOUSLY INJURED.
What are Florida’s laws on distracted driving?
Florida has passed several laws to reduce distracted driving. In 2019, the state passed the Wireless Communications While Driving Law, which makes texting while driving a primary offense. A primary offense means that police officers can pull someone over just for texting while driving. Here’s what the law says:
- You cannot manually type into a phone while driving.
- You cannot hold your phone in a school zone or active construction zone.
However, just because a law exists does not mean everyone follows it. Every day, drivers ignore the rules and innocent people are hurt because of it. That is where we come in.
What should I do after a Miami distracted driving accident?
If you or a loved one were hit by someone who was distracted behind the wheel, take the following steps to protect your health and your legal rights.
- Even if the accident does not seem serious, you should call the police. You need an official report for your insurance claim and potential legal case.
- Go to the hospital or visit your doctor, even if you think you are fine. Some injuries take time to show up. Also, getting yourself checked out creates a medical record, which can help your case.
- If you can, take pictures of the accident scene, your injuries, the cars, skid marks, traffic signs, and anything else that might help show what occurred.
- If anyone saw the accident, ask for their name and contact information. Witnesses can help prove that the other driver was distracted.
- Do not talk to the other driver’s insurance company. They may call you and ask for a statement. Do not do this without talking to a lawyer first. The company is looking for ways to pay you less – or nothing at all.
Finally, call Hickey Law Firm. We can step in and protect your rights immediately. Our lawyers are prepared to investigate the accident, gather the evidence, and fight for the compensation to which you are entitled.
How do your Miami car accident lawyers prove distracted driving?
Proving distracted driving is not always easy, but it is something we do all the time here at Hickey Law Firm. Here is how we build a strong case:
- We can request the driver’s phone records to see if they were texting or using any apps at the time of the accident.
- Cameras near the intersection, businesses, or traffic lights may have recorded the driver’s behavior. We know how to retrieve and review this footage.
- We talk to witnesses who may have seen the driver texting or not paying attention.
- The police report may note if officers saw a phone in the driver’s hand or found one on the floor of the car.
- Newer cars may store data about sudden braking or steering, which can show how the driver was reacting to obstacles in the road.
What is the value of my Miami distracted driving accident case?
If a distracted driver caused your injuries, Florida law allows you to seek compensation. Depending on your case, you may be able to recover money for:
- Medical bills (past, present, and future)
- Lost wages and loss of future earning ability
