NEWS: Florida Federal Court Order Denies Target’s Motion for Summary Judgment in Slip and Fall Case
A man named Michael Eddings was on his way to check out at Target, but as he approached the checkout lane with his cart, there was a plastic bag in his pathway, causing him to slip and fall. As a result, he filed a lawsuit against Target Corporation for negligence.
According to Law 360, there are a lot of disagreements occurring within this case. However, there are several facts that remain true, such as:
- On March 22, 2021, Michael Eddings was at target.
- A few minutes before 7:45 p.m., Eddings was on his way to the cash registers in the checkout lanes at Target.
- He was pushing a cart when he claimed that he slipped and fell due to a plastic bag being in his way.
- He did not realize that there was a bag in his pathway before he slipped and fell.
There was 29 minutes of surveillance video footage from the Target store showing the moments where Eddings made his way to the checkout lanes. In the video, you can see two different rows of cash registers. You can also see Eddings going to the register. A couple short seconds before 7:45 p.m., the camera footage shows Eddings slip and fall.
Eddings filed a lawsuit against Target Corporation on June 2, 2022. In the lawsuit, he claims that Target was negligent in maintaining and keeping its premises safe, which led to his injuries. Target Corporation recently argued for summary judgment, stating that there was no actual or constructive notice of the bag. However, since there is a dispute of material fact, the federal court denied the motion for summary judgment on February 5, 2024.
